From what moment can I challenge the cadastral value?

The cadastral value of real estate can be challenged from the date when the cadastral value is applied pursuant to Article 24.18 of the Federal Law No. 135-FZ "On Valuation Activity in the Russian Federation"; Article 22 Part 4 of the Federal Law No. 237-FZ dated July 3, 2016 "On the State Cadastral Valuation".

Until what moment can I challenge the cadastral value?

The cadastral value can be challenged before the date when the results of the next cadastral valuation are entered into the Unified State Register of Real Estate pursuant to Article 24.18 of the Federal Law No. 135-FZ "On Valuation Activity in the Russian Federation"; Article 22 Part 4 of the Federal Law No. 237-FZ dated July 3, 2016 “On the State Cadastral Valuation".

How far back can I challenge the cadastral value?

The cadastral value can be challenged for the current and subsequent years, until the results of the next cadastral value are entered into the Register. Early challenging the cadastral value allows you to get great savings on tax and rental payments pursuant to Article 24.18 of the Federal Law No. 135-FZ "On Valuation Activity in the Russian Federation"; Article 22 Part 4 of the Federal Law dated July 3, 2016 No. 237-FZ "On the State Cadastral Valuation".

How can I recalculate tax and rental payments after reducing the cadastral value?

If you need to to recalculate rental payments, do the following:

  • Enter the cadastral value into the Unified State Register of Real Estate and then apply to the landlord for recalculation of rental payments starting from January 1st of the year in which such application was filed. See the Decree of the Moscow Government No. 273-PP dated April 25, 2006 "On Improving the Procedure for Setting Land Rent Rates in the City of Moscow".

If you need to recalculate tax payments, do the following:

  • Enter the cadastral value into the Unified State Register of Real Estate and then apply to the Tax Inspectorate to recalculate tax payments starting from January 1st of the year in which such application was filed pursuant to Article 52 Paragraph 2.1 of the Tax Code of the Russian Federation.
Will challenging the cadastral value affect the results of the next cadastral value?

The methodological recommendations do not provide for applying the results of challenging the cadastral value; however, as challenging the cadastral value involves adjustment of data which the state appraiser could not obtain, the results of challenging the cadastral value significantly affect the determination of the cadastral value in the future. See the Methodological Guidelines approved by Order of the Russian Ministry of Economic Development dated May 12, 2017 No. 226.
